Terms of Service

Welcome to MadCreative ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the MadCreative platform, including our website, applications, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3. Use of the Service

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Attempt to gain unauthorized access to any systems or networks connected to the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to store or transmit malicious code
  • Resell, sublicense, or make the Service available to third parties without our written consent

4. Your Content

You retain all rights to the content, data, and materials you upload, submit, or create through the Service ("Your Content"). You grant us a limited license to use, process, and store Your Content solely to provide and improve the Service. We will not sell, share, or use Your Content for advertising purposes.

5. Subscription and Payment

Certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' written notice.

6. Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. No credit card is required to start a trial.

7. Cancellation and Termination

You may cancel your subscription at any time through the Service settings. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your access to the Service if you violate these Terms, with or without notice.

8. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy. By using the Service, you consent to our data practices as described therein.

9. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by MadCreative and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADCREATIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless MadCreative from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
